These Terms of Service ("Terms") are a binding agreement between Bipply ("Bipply", "we", "us") and the business registering for an account ("Merchant", "you"). By creating a Bipply account, you confirm you have the authority to bind the business named on the account, and you agree to these Terms.
If you do not agree, do not create an account or use the Service.
Bipply is a digital loyalty platform for cafés, restaurants, and other merchants in Egypt. The Service lets you issue branded loyalty cards that live in Apple Wallet and Google Wallet, record stamps and points through a tablet scanner, send push notifications and campaigns to enrolled customers, and view analytics through a web dashboard.
We may add, change, or remove features over time. We'll make reasonable efforts to tell you about changes that materially reduce what your plan includes.
You must provide accurate business information when signing up, and keep it up to date. You're responsible for everything that happens under your account, including actions taken by staff logins you create.
You must keep your login credentials confidential. Tell us immediately if you suspect unauthorized access to your account.
You're responsible for the content you upload (logos, card designs, campaign messages) and for making sure it doesn't infringe anyone else's rights or violate Egyptian law.
You will not use the Service to send spam, misleading offers, or content that is unlawful, defamatory, or fraudulent. You are responsible for honoring the rewards and offers you configure on your own loyalty cards — Bipply is the platform that delivers them, not the party redeeming them.
You are responsible for obtaining your customers' consent to enroll them in your loyalty program and to receive push notifications from you, in whatever form is required by applicable law.
Paid plans are billed in advance on a recurring basis as described at checkout or in your plan details. Any free trial period is as stated at signup or in an active promotion; we may change or end trial offers for new signups at any time without affecting merchants already using the Service.
Fees are non-refundable except where required by law or where we state otherwise. If a payment fails, we may suspend access to paid features until it's resolved.
We may change our pricing with at least 30 days' notice before it applies to your next billing cycle.
You own the business data you put into Bipply — your card designs, your customer list, your transaction history. We process it on your behalf to provide the Service.
Where the Service involves personal data of your customers (name, phone, wallet card activity, location for geofenced messages), you are the data controller and Bipply acts as your data processor, in line with Egypt's Personal Data Protection Law (Law No. 151 of 2020). You are responsible for having a lawful basis to collect and process that data and for your own privacy notice to your customers.
We apply reasonable technical and organizational measures to protect data in our systems, and we will not sell your data or your customers' data to third parties.
If you close your account, we will delete or anonymize your data within a reasonable period, except where we're required to retain it (e.g., billing records) or where it's already anonymized in aggregate analytics.
Bipply owns the Service itself — the software, design, and branding. Nothing in these Terms transfers that to you.
You own your own brand assets (logo, card colors, business name) that you upload. By uploading them, you grant us a license to display them back to you and your customers as part of operating the Service — nothing more.
We aim to keep the Service available and reliable, but we don't guarantee uninterrupted access. We may need to take the Service down temporarily for maintenance, and we'll try to do that at low-traffic times when possible.
You may cancel your account at any time from your dashboard settings or by contacting us. We may suspend or terminate an account that breaches these Terms, doesn't pay fees when due, or where we reasonably believe it's being used unlawfully.
On termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (data handling, liability, governing law) continue to apply.
The Service is provided "as is." To the fullest extent permitted by Egyptian law, Bipply is not liable for indirect, incidental, or consequential damages (such as lost profits or lost customers) arising from your use of the Service.
Our total liability for any claim relating to the Service is limited to the fees you paid us in the three months before the claim arose.
We may update these Terms from time to time. If a change is material, we'll notify you by email or an in-dashboard notice before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.
These Terms are governed by the laws of the Arab Republic of Egypt. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the competent courts of Cairo, Egypt.
